Terms & Conditions

Your order is an offer to purchase the products you specified ("Products") according to the terms and conditions below. These terms will become a contract ("Agreement") when your order is accepted by Monel USA, LLC. (Monel) either by sending you a confirmation that specifically references your order or by shipping the Products to you. You represent you have the legal authority to enter into this Agreement on behalf of yourself or any party you represent.

Returns will only be accepted if the product is purchased from www.monelusa.com. For products purchased elsewhere, please direct your return request to the designated retailer. All returns must be made within thirty (15) days of the delivery date and include proof of purchase, a copy of your original order, or invoice. The product must be in perfect condition, unused and in original packaging including all hangtags and labels. Products that have been washed, modified, damaged, or used (hereunder smell of e.g. perfume or cigarettes) will not be accepted. No products shipped hereunder may be returned without Monel USA’s prior approval. To request an RMA please contact our returns department either by e-mail at info@monelusa.com.

Shipping charges may be an additional cost. P.O. Box, APO, and FPO addresses cannot be shipped to using UPS.

Risk of loss will transfer to you when Monel delivers your order to the delivery service.

Payments are captured at the time an order is placed.

All applicable taxes will be applied to your order.

This agreement shall be governed by the laws of the State of Wisconsin, without regard for its conflict of law provisions.

Monel warrants that the Products will be free of defects in materials and workmanship for a period of one (1) year from the date of purchase. If any Product should become defective within the warranty period, Monel, at its option, will replace or repair it. Repair or replacement parts or Products will be furnished on an exchange basis and will either be new or reconditioned. All replaced Products shall become the property of Monel. Warranty service is available to you by delivering the Product during the warranty period to Monel at 4915 Voges Rd., Madison, WI 53718 USA and providing proof of purchase, price, and date. The buyer must first e-mail Monel at info@monelusa.com to obtain a return approval and return number. You will bear all shipping, packaging, and all other costs, excluding labor and parts, necessary to effectuate repair, replacement, or refund under this warranty. THIS LIMITED WARRANTY DOES NOT EXTEND TO ANY PRODUCT WHICH HAS BEEN DAMAGED AS A RESULT OF ACCIDENT, MISUSE, ABUSE OR AS A RESULT OF UNAUTHORIZED SERVICE. THIS WARRANTY IS IN LIEU OF ALL OTHER EXPRESS WARRANTIES FOR THIS PRODUCT. IMPLIED WARRANTIES, INCLUDING THOSE OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT SHALL HAVE NO GREATER DURATION THAN 1 YEAR FROM THE DATE OF PURCHASE. IN THE EVENT THIS PRODUCT BECOMES DEFECTIVE DURING THE WARRANTY PERIOD, THE PURCHASER'S EXCLUSIVE REMEDY SHALL BE REPAIR OR REPLACEMENT AS PROVIDED ABOVE.

IN NO EVENT SHALL PROCLIP BE LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROPERTY, ARISING FROM BREACH OF ANY EXPRESSED OR IMPLIED WARRANTY.

MONEL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, OTHER THAN THOSE EXPRESSLY STATED IN SECTION 8.

Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above exclusion may not apply to you.

This warranty gives you specific legal rights, and you may have other rights that vary from state to state.

Monel may revise or discontinue Products at any time.

MONEL'S TOTAL LIABILITY WHETHER FOR BREACH OF CONTRACT, WARRANTY, LATE DELIVERY OR NON-DELIVERY, NEGLIGENCE, STRICT LIABILITY IN TORT OR OTHERWISE, IS LIMITED TO THE PRICE OF THE PARTICULAR PRODUCT(S) SOLD WITH RESPECT TO WHICH LOSSES OR DAMAGES ARE CLAIMED. IN NO EVENT WILL MONEL BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING, WITHOUT LIMITATION, INDIRECT, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING ATTORNEY FEES ARISING OUT OF THE USE OF OR THE INABILITY TO USE THE PRODUCTS, OR FOR ANY CLAIM BY ANY OTHER PARTY, EVEN IF PROCLIP HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You agree to comply with all applicable laws and regulations of the various states and of the United States and other countries that relate to the Products or this Agreement. Monel has separate terms and conditions governing the sale of Products to the U.S. Government and registered Resellers.

This Agreement may not be altered, supplemented, or amended by the use of any other document(s). Any such attempt will be null and void unless otherwise agreed to in a written agreement signed by both you and Monel.

If any provision of this Agreement is held to be invalid or unenforceable by any law, rule, order or regulation of any government or by the final determination of any state or federal court, such invalidity or unenforceability of any one or more of the provisions hereof shall not affect the validity or enforceability of the other provisions hereof.

Monel USA periodically offers special discounts on items via direct discount or coupon code. Items being offered with a direct discount will have their final sale price reflected during checkout. Any discount offer with a coupon code will require that the code be entered by the customer on the checkout screen. Unless otherwise stated, coupon codes are limited to one per order and may not be combined with any other offer. Monel notifies customers of upcoming discounts using social media and email. Sign up for special offer emails here. Discounts are valid during specified timeframes only. Orders completed before or after specified timeframes are not eligible for that discount. Monel USA reserves the right to cancel any discounts or coupon codes at any time.

Monel USA offers a significant discount on select overstocked items in our Clearance section. These items are offered on clearance discount while supplies last. No rainchecks or backorders on these items will be offered. Unless otherwise stated these items are excluded from all coupons, sales, and special offers. All sales of clearance items are final. No returns of clearance items will be accepted.
